Experience

Mr. Jackson practices in all areas of intellectual property. He represents both foreign and domestic clients in patent and trademark prosecution, interferences, and reexaminations before the United States Patent & Trademark Office. Mr. Jackson also has substantial experience in drafting exculpatory opinions on the issues of patent infringement and validity and performing due diligence and evaluation of IP portfolios for corporate mergers and acquisitions. In recent years, Mr. Jackson has transitioned a significant portion of his practice to patent and trademark litigation and he has represented clients in jurisdictions including the District of Delaware, District of Columbia, and Eastern District of Texas.

Mr. Jackson has substantial experience in a number of industries and technologies, including VoIP, wireless telecommunications devices, systems and services; computer technology, including software, hardware, database management, client server networks, SONET networks, microprocessors, memory, digital signal processors, circuit design, and semiconductor technology; Internet technology, including portals, electronic selling, buying, advertising, billing, auctioning, reservation, training, publication and other online businesses; radar and antenna technology; Two-dimensional color barcodes, modulation technology; connection devices; cable theft monitoring devices; pre-pay calling systems; check verification systems; database systems; document management systems; fire starting devices; spectroscopy devices; contour determination devices; and golf systems.

Prior to joining Murphy & King, Mr. Jackson worked for Bingham McCutchen LLP and before that was employed by the U.S. Patent and Trademark Office as a patent examiner. He examined patent applications for computer-related technology involving graphical user interfaces and selective visual displays, Internet hypermedia and structured documents, and object-oriented database structures and information.

During law school, Mr. Jackson was employed by Cornell University Research Foundation as a technology transfer intern, where he helped to develop patent licensing strategies and draft technology licensing agreements. He also speaks conversational Spanish.

Representative Engagements
  • Litigation Engagements:
  • Representing the defendant in a trademark infringement action.
  • Represented the defendant in a patent infringement action involving MEDS (multi-point video and data distribution system) wireless telecommunications services. The Jury found for the defendant on invalidity and non-infringement.
  • Represented the plaintiff in a patent infringement action involving viruses and vaccines made from certain Modified Vaccinia Ankara. The case settled favorably to the plaintiff.
  • Represented plaintiff in a patent infringement action involving wireless power management to mitigate interference between devices on a Local Area Network. The validity of the patent was maintained.
  • Engagements before the Board of Patent Appeals and Interferences (BPAI):
  • Representing the Senior Party in an interference proceeding involving building panel technology.
  • Represented the Senior Party in an interference proceeding involving an actuator assembly for MEMS Mirror System. The BPAI panel entered an adverse judgment against the Junior Party at the end of the preliminary motions phase.
