Kindercare Learning Centers': last tango with ERISA for the Autumn, 2005 issue of Massachusetts Medical Law Report. The article discusses the evolved consensus among federal courts on the efficacy of the ERISA defense in circumstances where contracts or other common law duties affect the rights of insurers and providers.
