Experience

Mr. Dwyer has tried dozens of jury cases in Massachusetts courts and has extensive experience in alternative dispute resolution. He handles a variety of business and commercial disputes, including cases arising out of the sales of businesses and matters involving various forms of fiduciary liability.

Mr. Dwyer served as an assistant district attorney in Plymouth County, Massachusetts, and as a law clerk to the Justices of the Massachusetts Superior Court. Before attending law school, he served as a Special Agent with the U.S. Department of Justice, Drug Enforcement Administration.

  • $5 million trial verdict for co-founder of internet marketing firm whose former partners interfered with stock repurchase agreement between co-founder and firm.
  • Trial verdict for plaintiff software company in suit for theft of trade secrets by former employee.
  • Trial verdict for defendant commercial realty company in suit alleging failure to account adequately for rents and profits.
  • Preliminary injunction for plaintiff, partner in venture capital firm, requiring defendant venture firm to pay plaintiff’s salary during suit, which concerned venture firm’s breach of contract and fiduciary duty. Case settled favorably.
  • Trial verdict and award of attorneys’ fees for homeowners in suit against real estate developer.
  • Trial verdict for veteran of Iraqi conflict in suit against Commonwealth of Massachusetts for deprivation of child-visitation rights.
  • Represented trust beneficiary in suit against trustee-bank and investment advisory firm for failure to diversify and breach of duty of loyalty. Successfully opposed motion for summary judgment and obtained favorable settlement for beneficiary.
  • Summary judgment for construction company president in suit brought by holder of assigned promissory note.
  • Represented national and local sportsmen’s organizations in suit brought by groups seeking to enjoin local pheasant hunt. Successfully opposed plaintiffs’ motion for preliminary injunction.
  • Represented president of closely-held corporation in suit by minority shareholder alleging breach of fiduciary duty. Settled favorably in mediation.
  • Represented minority shareholder of closely-held corporation in corporate freeze-out suit against majority owners. Settled favorably in mediation.
