Experience
Mr. Evans joined Hanify & King in 1982. For more than 20 years, he has represented large public corporations, closely held companies and individuals in the resolution of complex business disputes. This focus places Mr. Evans in a variety of settings for his clients, including federal and state court, arbitration, mediation, and administrative agencies. He has litigated precedent-setting cases in areas such as leveraged buyouts, computer law, unfair trade practices, and patent licensing.
Mr. Evans also maintains an active practice as a certified neutral arbitrator and mediator, serving in more than 150 cases. He has presided over a broad range of business disputes involving areas such as intellectual property rights, finance and accounting, supply agreements, technology development and transfer agreements, stock purchases, and business separations. Mr. Evans is a member of a number of arbitration panels, including the Commercial and Large, Complex Case Panels of the American Arbitration Association. Mr. Evans also conceived of and co-founded the Technology Company Mediation Program for the Massachusetts Software and Internet Council (known now as Massachusetts Technology Leadership Council), and is a frequent lecturer on ADR.
Mr. Evans was selected as a 2006 Massachusetts Super Lawyer and 2007 New England Super Lawyer in Business Litigation based on a poll of his peers, and maintains an “AV” rating (the highest available) from Martindale-Hubbell.
Representative Engagements
- Successfully defended private investment firm in $300 plus million claim by bankruptcy trustee involving a leveraged buyout of a public corporation. Overall, Mr. Evans has represented parties in multiple cases involving challenges to leveraged buyouts.
- Represents distressed debt holders with claims in excess of $1 billion in various bankruptcy cases.
- Represents NYSE computer services firm in contractual and licensing disputes in Massachusetts.
- Represents Fortune 500 telephone company in litigation in Massachusetts.
- Represents NYSE provider of products and services to the petroleum industry in litigation and ADR disputes in Massachusetts.
- Successfully defended inventor in multi-million dollar patent license dispute involving numerous patents for medical devices and techniques.
- Represented commercial bank in arbitration proceedings concerning defective transaction processing software, obtaining $2.5 million award for unfair business practices. Settled similar dispute for a publicly traded Massachusetts bank involving the same software package.
