Last month, I gave a presentation at the International Patent and Trademark Conference in Kitzbuhel, Austria. My remarks focused on whether a trademark owner must show “actual harm” in order to obtain an injunction under the Federal Dilution Act of 1995 prohibiting the use of a similar mark by an alleged diluter.

In October 2002, the Massachusetts Commission Against Discrimination (“MCAD”) issued guidelines which consolidate into a single document the current tenets of sexual harassment law under the Massachusetts Fair Employment Practices Act, General Laws Chapter 151B. The Sexual Harassment in the Workplace Guidelines (the “Guidelines”) do not create new law.
