Boston – (April 8, 2008) - Hanify & King, Professional Corporation today announced the opening of its new offices in Washington, D.C. The new office will focus on patent litigation, patent prosecution, and intellectual property. At the outset, the new office will be staffed by five lawyers joining the firm from Bingham McCutchen’s Washington, D.C. office and by litigators in Hanify & King’s Boston office. The new Washington, D.C. office will be headed by attorney Edward Pennington, an accomplished patent litigator who has handled complex patent cases during the last 25 years.

“We have had the good fortune to have worked with our new colleagues at their old firm, to have shared assignments for common clients, and to have confirmed our common commitment to professional excellence and personalized service to our clients,” said attorney Jim King, co-founder, Hanify & King. “This new office will integrate IP litigation with our trial practice resources in Boston. It expands our ability to serve our clients and also connects what we do very well in complex commercial trial practice, with patent and intellectual property litigation.”

Hanify & King’s 20-person trial practice team is notable for its success in business cases. For the past two years, the firm has succeeded in securing verdicts for its business clients that rank in the top ten in Massachusetts.

In addition to his patent litigation practice, Edward Pennington was trained as a patent lawyer and has extensive experience in patent and trademark prosecution, patent licensing, due diligence associated with IP transfers, and opinion work. He represents both U.S. and foreign-based clients involved in various industries, and he has successfully appeared before the U.S. Patent and Trademark Office, the Board of Patent Appeals and Interferences, the Trademark Trial and Appeal Board, the Federal Circuit, and the Fourth Circuit.

He has litigated in a wide range of technical fields, including telecommunication equipment and services, computer security and encryption, sporting equipment, vaccines, nuclear reactors, ceramic materials and processes, military armament, electric motors, turbines, consumer electronics, computer architecture, and business methods.

Pennington has been lead trial counsel in the more frequently used patent venues throughout the United States, including Virginia, Delaware, Texas, California, New York and the U.S. International Trade Commission. He is a member of the American Bar Association, American Intellectual Property Law Association, Virginia State Bar, Intellectual Property Law Section and Licensing Executives Society.

Pennington graduated from West Virginia University with a Bachelor of Science in Economics and Physics and a Master of Arts in Econometrics. He received his Juris Doctor from George Mason University School of Law and resides in Washington, DC.

Pennington will be joined by four additional patent attorneys – Stephanie Scruggs, Sid Pandit, Michael Schwartz and Chadwick Jackson.

Stephanie Scruggs has represented clients in a variety of intellectual property matters, including preparing and prosecuting domestic and foreign patent applications in the chemical, biochemical, pharmaceutical and mechanical arenas. She has also practiced rendering patentability, invalidity and infringement opinions, and she counsels on trademark, copyright and patent issues. Scruggs holds a Bachelor of Science and Master of Science in Chemical Engineering, from the University of Mississippi and Virginia Polytechnic Institute and State University respectively. She received her Juris Doctor from George Mason University School of Law. She resides in Vienna, VA.

Sid Pandit provides litigation support in patent, trademark and trade secret cases. He also prepares and prosecutes new patent applications, patentability, invalidity and non-infringement opinions. He conducts IP due diligence for corporate mergers and acquisitions, including evaluating patent and trademark portfolios and open-source copyright issues. Pandit graduated from George Washington University with a degree in Electrical Engineering and received his Juris Doctor from Catholic University of America, Columbus School of Law. He resides in Bethesda, MD.

Michael Schwartz writes patent applications for electrical and software clients. His patent practice focuses on database software, telecommunications and network hardware and software, including optical network hardware and software, hard disk drive hardware, coding, and software, and computer malware detection software. Schwartz graduated from the California Institute of Technology with a degree in Electrical Engineering and Management. He received his Juris Doctor from The George Washington University Law School. He resides in Arlington, VA.

Chadwick Jackson provides litigation support and assistance in the trial of patent cases. He also represents clients in preparing and prosecuting patent applications; rendering opinions on the issues of patent infringement and validity; performing due diligence, including conducting patentability, product clearance, validity and prior art searches; drafting license agreements, including software license agreements and distribution agreements; developing and enforcing patent portfolios; and advising clients on trademark and copyright matters. Jackson received his Bachelor of Science in Computer Engineering and his Juris Doctor from Syracuse University. He resides in Upper Malboro, MD.

The Boston attorneys who will be supporting the new patent and IP litigation practice include Jeffrey Upton, David Evans, Michael Marcucci and Ted Folkman.

Jeffrey Upton is a trial lawyer who has successfully tried dozens of cases in state and federal court, leading a team of Hanify & King trial lawyers in securing for clients over the last two years among the largest civil verdicts in Massachusetts. Upton is a graduate of Brown University and Boston University School of Law.

David Evans is a trial lawyer who has managed and tried complex financial and business claims in state and federal court. He has litigated precedent-setting cases in areas such as leveraged buyouts, computer law, unfair trade practices, trade secrets and patent licensing. Evans is a Denison University graduate and received his Juris Doctor at Syracuse University College of Law.

Michael Marcucci concentrates his practice on general business litigation and government investigations. Marcucci practiced for five years in the Boston office of Ropes & Gray before joining Hanify & King and is a graduate of Harvard College and Boston College Law School.

Ted Folkman concentrates his practice in complex business and intellectual property litigation. Folkman received his undergraduate degree at Princeton University, a masters degree from Columbia University and his law degree from Harvard Law School. After law school, Folkman clerked for Judge Ann Aldrich of the U.S. District Court in Cleveland.
